These Terms govern your use of the video processing platform and services provided by 4D-360 Inc, a Delaware corporation. By using the Service, you agree to these Terms.

1. Your Content

You retain ownership of all content you upload. We only use your content to provide the Service and do not sell or share it with third parties except as needed to operate the platform. You are responsible for ensuring you have the rights to upload your content and that it complies with applicable laws.

2. Acceptable Use

You agree to use the Service only for lawful purposes. You may not upload infringing, harmful, or illegal content; reverse engineer the Service; use automated scraping tools; or resell access without our written permission. We may suspend accounts that violate these Terms.

3. Privacy and Data

Our Privacy Policy describes how we collect and use personal information. We implement reasonable security measures including encryption of data in transit and at rest. Your content may be stored and processed in the US and other countries where our service providers operate.

You may delete your content at any time. After account termination, you have 30 days to retrieve your content before it is permanently deleted.

4. Service Availability

We target 99.5% uptime for paid tiers (excluding scheduled maintenance). Processing times vary based on file size, complexity, and system load and are not guaranteed. Storage and usage limits depend on your subscription tier. We may modify or discontinue features at any time.

5. Payment

Fees are in U.S. dollars and billed in advance on a recurring basis until you cancel. All fees are non-refundable. You are responsible for applicable taxes. We will provide at least 30 days' notice of fee increases.

6. Intellectual Property

The Service and its technology remain our exclusive property. We grant you a limited, non-exclusive, revocable license to use the Service for your business or personal purposes. Any feedback you provide may be used by us without compensation or attribution.

7. Disclaimers and Liability

The Service is provided “as is” without warranties beyond those expressly stated here. We are not liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the amounts you paid us in the 12 months preceding the claim, or $100 if no amounts were paid.

8. Indemnification

You agree to indemnify 4D-360 Inc against claims arising from your use of the Service, your content, or your violation of these Terms. We will indemnify you against third-party IP infringement claims related to the Service when used as permitted.

9. Termination

You may terminate your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, security risks, or legal requirements. Upon termination, your access ceases immediately and content is deleted per our data retention policy.

10. Governing Law

These Terms are governed by the laws of Delaware. Disputes will be resolved by binding arbitration under AAA Commercial Arbitration Rules in Delaware. You waive the right to participate in class actions.

11. General

These Terms constitute the entire agreement between you and 4D-360 Inc. We may modify them with 30 days' notice for material changes. If any provision is unenforceable, the remainder stays in effect. You may not assign these Terms without our consent.
